A three-judge panel of the Missouri Court of Appeals on Tuesday upheld a Jackson
County Court’s decision affirming an arbitrator’s finding that the woman was entitled to
an award of $5.2 million dollars.

Geico was originally contacted by the plaintiff after contracting HPV virus while
engaging in unprotected sex in a Geico-insured 2014 Hyundai Genesis. Geico refused,
saying that it was not a covered event under its insurance policy.

Ultimately, the case went to arbitration and the woman was awarded 5.2 million dollars
for damages and suffering.

The man who infected the plaintiff did not disclose he had been previously diagnosed
with an HPV virus infection, and had proceeded to engage in unprotected sex in the
vehicle.

The judgement was affirmed. Geico claimed they were not informed of the arbitration
proceedings. The appeals court found that Geico did not have the right to “re-litigate”
the issues after the award had been affirmed.
